apologize I needed to have two days off as we have sadly had a de in the family and we had things to sort but it doesn't stop me talking about the aftermath and just touching on a couple of things social media attorneys for Brian cerg argue his murder trial should be relocated because potential jurors voice concerns that the public would burn the courthouse down if he has acquitted of murders of murder charges um an Idaho judge abruptly haltered Brian cober's hearing on Thursday after an expert witness for the defense showed social media posts in the Moscow courtroom koberger who is accused of killing four University of Ido students in November 2022 was back in court as a defense team fights to relocate his murder trial arguing a mob mentality has formed against him which it absolutely 100% has whether you're Pro Burger whether you're anti- Burger whether you're straight down the middle Burger there is a mob mentality 100% And I'm going to touch on Steve gon salz and Christy gon Sal was in a moment which is proof in the pudding right so the third defense witness was Brian Edelman a co-founder of California based jury consultancy trial Innovations who was hired to conduct a survey of prospective jurors in lar County during his presentation Edelman showed a screen recording of him scrolling through the Facebook post result that appeared when he searched Moscow murders cobber was charged with the murders of Kaye gon salvas M Mogan Anna canal and Ethan chapen was stabbed to death in their off campus student home in Moscow Idaho on November 13th 2022 um we'll just skip down here minute in a motion filed last week cober's lawyers surveyed potential jurors in Lear County who said there could be violence in the local area if he was not found guilty potential jurors said there would likely be a riot and they' burn the courthouse down now as a subote to this we also have a another request for Discovery we've got a 17th supplemental request for Discovery you know when we was talking about how nuts it was back at 8 and nine and 10 um yeah we're now on the 17th please take notice that the underside pursuant to rule 16 of Idaho criminal rules 4 F 6 8 14th amendments to the Constitution the United States in Article 1 1 2 1317 the constitution of the state Idaho request Discovery and inspection of all materials discoverable by defendant per icr 16b 1-8 and the aformentioned Constitutional Provisions excluding but not limited to the following information evidence and materials outlined in exhibit P so we do have another request for discovery which is strange in this case is it because we don't see many of them but yeah look so Judge John judge they failed to reach a conclusion with Judge John judge turning around judging mcjudgerson saying this is the hardest decision that he is going to make in his professional career well I'm going to say then you've had a [ __ ] easy run of it run of it because this ain't hard this ain't a difficult decision you have a right as a judge to be completely unbiased so completely unbiased you have to make decisions which function in accordance to the law and as my mate Eddie said the other day they have a responsibility to provide Brian coburger with a trial setting that is absolutely as unbiased as physically possible and lar County provides the worst option the worst now it could be argued that he would struggle to get a fair trial somewhere else but you can absolutely bet your bollocks to a barand dance at latar county is the worst and if he retains the trial in Lear County then that is Doan Brian cobber over he might as well Bend him over and do stuff to him because that's what you're doing this is not a place where you're going to get a fair trial now they talk about you get like Brian from over at news Nation talking about the family the family don't want it moved well of course they don't family don't want it moved because they know that he's more likely to get found guilty in Lear County Steve gon salvas was asked the flat out do you think that there can be a fair trial in Lal County and the fact that he said Yes means that he over not listening and reading his messages all over his gon Sal's Army of Doom because you're not going to get a fair trial there absolutely what and they turn around and say well we shouldn't move it because the families don't want to the families didn't want the house knocked down but that got knocked down but because it's well that was bad for business I'm sure but do you know what I mean the point being they it shouldn't have anything to do with the families I know that it's a very sad and tragic situation the families have lost family members in the most heinous heinous act and if Brian coburger is guilty of this crime then so be it but what you've got to consider is that there is such hatred for Brian cerg out there that I don't even think it's about whether he's guilty or innocent anymore people have made their mind up and they just out for blood case and point being when they're talking about whether they can look at Brian cerg in the courtroom you know do you struggle to look at him can you look at him and the gon salz family are like no we just look at him we look at him and it's like but the guy has not been found guilty yet now you could go and run this even further and this is something that I'm going to be talking about in a live I think Sunday and it was you you have a situation with the gon salz that they act very much like they've had Insider information now if they have if they have been liasing with people in law enforcement and they have information that not even the defense has and they know beyond a reasonable doubt that Brian coburger did it then is that even fair is that a fractured system and is that indicative of a situation whereby Brian cobber shouldn't then be in here and that's the bad thing isn't it the things need to operate right to not only make sure that convicted people stay convicted or not or innocent people don't get convicted do not I mean the system has to work for a specific reason to make sure that the results that are garnered are the right results for the actual crimes and people just don't seem to care people really just don't seem to care it just seems to be a bunch of people who are running around a field like headless chickens wanting the result that they've conjured up in their brain as being the right outcome they they want the satisfaction of being right when you know what can the gon salvas family have seen beyond what we've seen and if they have concluded that Brian cobber is guilty and they have seen exactly the same as what we have seen then that is indicative of bias because in my opinion and it is a nonprofessional opinion there is not enough to convict this guy and even if I had skin in the game I would not be satisfied that what I've seen so far proves and in fact I would be questioning things it would concern me so it is indicative of bias unless people have got access and have seen things that we have not seen and how would you feel if that genuinely is the case that we have a system that is allowing people at Ground Zero to see stuff that they should not be seeing prior to the trial double-edged sword isn't it double-edged sword but we don't have an outcome we don't have an answer the judge is going to ponder over it but this trial needs to move however you feel about this situation the trial needs to move because later count county is the worst possible place and if this gets tried in this place there's going to be an appeal 100% 100% that will be grounds for appeal straight there that they tried this court in the absolute worst possible place they did not take anything
