For the first time since prosecutors
attempted to revive her husband Alec Baldwin's Rust manslaughter case,
Hilaria Baldwin was spotted. The 40-year-old yoga instructor
appeared anxious on Thursday while out for a lone coffee run in New York City. She was holding a drink in one hand and
putting her hair back with the other, wearing black jogging shorts and a white tank top. The mother of seven kept a low profile as she walked through the downtown streets
wearing dark expensive sunglasses. According to a court document made public
on Wednesday, the disclosure occurs after a state attorney requested that a New Mexico judge
reevaluate tossing Alec's involuntary manslaughter charge in the fatal Rust set shooting of
cinematographer Halyna Hutchins in 2021. Special prosecutor Kari Morrissey contended
that Baldwin's right to due process was not violated and that the July ruling
lacked a solid factual foundation. Judge Mary Marlowe Sommer of the State
District Court had already dropped the case in the middle of the trial, stating
that prosecutors and police had concealed information from Baldwin's defense in
the gunshot that claimed Hutchins' life. Since the charge was dismissed with prejudice, it cannot be re-filed after any
possible appeals have been settled. Director Joel Souza was injured and
cinematographer Halyna Hutchins was killed when Rust star Baldwin accidentally fired the
revolver he was holding during a scene rehearsal. The star of 30 Rock has stated
that before the pistol exploded, he drew back the hammer but
did not squeeze the trigger. The case rested on ammunition that a guy had
presented to the sheriff's office in March, claiming it could have something
to do with Hutchins's demise. The ammo was thrown out by the prosecution as
irrelevant, but Baldwin's attorneys accused the prosecution of hiding it, which helped
them win a request to dismiss the case. Special prosecutor Morrissey contended that
Baldwin's obligation to adhere to gun safety regulations was the primary subject
of her request for reconsideration, dismissing the unreported ammo as unimportant. 'No one on the prosecution team... ever purposely
withheld evidence from the defendant; even if the rounds were identical or comparable to the live
rounds found on the Rust set, the prosecution just didn't think the rounds were relevant to
the case,' Morrissey stated in court filings. She asserted that the defense lawyers were aware of the ammo but declined to look
through it prior to the trial. "The defense constructed this
smoke screen in an attempt to perplex and influence the court,
and it worked," Morrissey wrote. Luke Nikas, Baldwin's lawyer, said
the court will receive a response. The armorer on set, Hannah Guttierez-Reed,
was found guilty in April of involuntary manslaughter in Hutchins's death
and given an 18-month sentence. She was scheduled to testify in
Baldwin's case and is presently serving her term at the Santa Fe
County Adult Detention Facility. Rust filming has resumed since the 2021
shoot, although it has moved to Montana per a deal with Hutchins's husband, Matthew
Hutchins, who became an executive producer. The finished film has not yet been made
available for general public screening.
