hi my name is Grace Goodman and I'm an attorney here at the neas law firm today I want to discuss with you the difference between penal code 273.5 and penal code 243 E1 the difference between domestic battery and corporal injury onto a spouse or other [Music] cohabitant so the elements need to be proven for domestic battery are as follows there has to be will there has to be harmful or offensive of contact and that contact has to happen between two people who either were in a romantic relationship or are in a romantic relationship sexual relationships do count for corporal injury onto a spouse or other domestic partner there has to be a willful injury and that injury has to happen between two people who either are in a domestic or are in a romantic relationship or were in a romantic relationship and a sexual relationship counts the big difference here is that domestic batter does not actually need to have an injury whereas corporal injury does that injury has to cause trauma onto the party who is injured it's also very important to note that same seex relationships apply to both of these penal codes the penal codes don't discriminate over heterosexual relationships or same-sex relationships if you have any questions about anything I just stated go ahead and give us a call we're happy to help [Music] yeah
