more criminal charges for Harvey Weinstein forthcoming in New York let's discuss I'm Dave aronburg state attorney for Palm Beach County aka the Florida law man here on True Crime MTN we all know about Harvey Weinstein the disgraced Hollywood Mogul who was convicted in New York and in California as part of the me too movement for sexually assaulting various women well his conviction in New York was overturned by the high Court there because the prosecution according to the court was improperly allowed to bring up evidence of other crimes that were not charged evidence involving other women that were not part of the indictment and uh Supreme Court in New York What's called the court of appeals found that that was too prejudicial it was a 4 to3 vote Harvey Weinstein's conviction was overturned in New York not in California in New York so he's still in prison and the prosecutors have said that he's going to face a new trial and they're going to try him again but this time according to the latest report there may be additional charges added to his case it's one of those situations be careful what you wish for Mr Weinstein you may get something even worse according to NBC News a New York Grand Jury has been convened away whether to bring new charges against the disgraced former movie Mogul a source with knowledge of the proceedings told NBC news adding that a decision could be announced as early as Friday Weinstein's attorney Arthur idala said Wednesday in a statement we'll be prepared for whatever comes our way they're going to do whatever they can to make sure Harvey doesn't see the light of day The Da announced in July that it was going to retry Weinstein on the original charges from the 2020 trial but that it planned to interview other alleged victims a few weeks later judge Curtis Farber set a trial date for November 12th in a source with knowledge of the case said any potential new charges likely would be folded into one trial in all more than 80 women have accused the Oscar winning producer of sexual assault or harassment the allegations first reported by the New York Times And The New Yorker set off the me too movement in which powerful Hollywood men were called out for alleged abuses of power Weinstein is maintained that any sexual encounters were consensual so he was found guilty in California found guilty in New York the California verdict Remains the New York verdict has been overturned but the trial there will happen again and this time possibly with new charges with new women added to that as long as it satisfies the statue limitations then it could be game on that's generally what happens in cases like this once you have some women speak up in because when it comes to sexual assault that is a generally underreported crime and people are afraid to come forward but then they see others come forward and that encourages people to find their voice and that's when you could have additional charges especially after Weinstein was found guilty in California so there's no potential for him really to get out of prison and take action against the accusers and I think for some of the accusers they're probably scared hey what happens if he comes after me well now that there's no chance of that happening I think it will help find the voice for some people who otherwise would never have come forward I think it will encourage new people to come forward and especially when it looks like he may get off scottf free in New York unless they have a strong case against him now you may see other women come forward saying yeah they want to be part of this Harvey Weinstein was seen as Invincible he was a top the Hollywood food chain I mean you watch any Hollywood award show and everyone had to thank Harvey Weinstein and every time that there was a movie that he had anything to do with he had to gush about Harvey Weinstein and now that he's disgraced he's the butt of jokes he's someone that no one wants to even have an association with and now you see not just people who allegedly have been victims of his sexual assault coming forward but now you see even others Marlon wayin the Hollywood actor said that he should have sued Harvey Weinstein for stealing his family's film ideas According to complex.com which is like a social a gossip site on the internet Marlon wein was a guest on a program and he talked about a feud with Weinstein regarding the scary movie franchise many of you have seen that movie which is a spoof on scary movies Wayne's explained that mirax the film's Weinstein based distributor gave them a crappy deal for the first installment of the comedy spoof film however the film went on to open with $42 million at the box office which he claim was unheard of at the time while the Wayne's Brothers got a better deal for the second installment in 2001 the professional relationship between the creatives in the studio soured for further sequels Marlin explained that the brothers and mirax couldn't reach a deal for Scary Movie 3 so the film company brought on the zooker brothers to direct it based on the ideas the way Way's Brothers shared during their pitch reportedly without their knowledge so it is time to pile on against Harvey Winson and apparently he seems to deserve it you know at the tri of Harvey Weinstein they brought up a lot of other bad acts that was another touchy area for prosecutors because you got to get permission from the court the court gave it to them and that's another way a case can be overturned on appeal if the appell court thinks that the prior bad Acts were more prejudicial than relevant to the case that they provided such inflammatory bits of information that they could sour the jurors on Harvey Weinstein having nothing to do with the case in front of them like things like yelling at waiters and just being an overall borish dude you know that kind of stuff that shows his bad character can only come in in limited doses in specific instances you can't just use it to prove propensity to commit a crime you can't say he's a bad guy so of course he committed this crime so prosec were given a lot of leeway in the case against Harvey Weinstein a lot of leeway to introduce prior bad acts things that had nothing to do with the alleged sexual assaults and to introduce other alleged victims individuals women who were not part of the indictment but could show that there was a pattern of activity that Harvey Weinstein had an Mo that this was not to show his propensity to do it but rather like his his signature his his habit and uh that's the kind of thing that they used against him you know the show Mo that what state of mind was and and ultimately it came back to prosecutors because the case the conviction was overturned on appeal it was a close decision 4-3 but Harvey wion is going to get a new trial although that new trial may contain more damaging information than he anticipated so we'll keep watching
