Where was? >> Let's back up. >> It was a male shooting white Latin male wearing a white shirt . >> Police were initially called to the Los Primos supermarket on Northwest 95th Street, near 31st Avenue, after reports that a man was firing a gun. >> I have casings on the scene, Thatrillionesponding officer notices bullet casings outside of the store. >> 93 he retrieves his rifle from his car and then notices the man, later identified as Selvin Figueroa martinez has exited the store. >> He tells him to get down. >> Let me see your hand. But Figueroa appears to reach for his waistband, and that's when the officer opens fire, firing around ten shots. >> The police officer, identified as Joshua Rodriguez, led into a cruiser as the investigation began. Get in the car. >> No phone calls. This is it. >> Right here. >> The state Attorney's office now determining his decision to open fire was justified. They have closed out the case. >> Figueroa was shot a total of four times, including in the chest and in the lower back. >> Despite that, he was transfer . He was transported rather to Jackson Memorial Hospital's Ryder Trauma Center, where he did survive. >> He is now facing several charges, including aggravated assault on a law enforcement officer.
