Plaintiffs Ask To Depose Scientology's Leader & Danny Masterson

day is a great day not to be in a Cults guys I want to start out by letting everyone in the Los Angeles area know that anyone who would like to come out tomorrow morning and support janeo one two and three from the Danny Masterson case there is going to be a hearing tomorrow morning at 9:00 a.m. downtown LA Stanley mosque Superior Courthouse Department 51 uh judge cola this hearing is going to be this is this is the latest update in the lawsuit that was brought by janeo one two and three Jane do 3's husband Cedric Bixler zala and um one of another one of Danny Master's victims who did not testify in one of the trials and isn't a Jane Doe doesn't go about doesn't use the Jane do moniker but her name is Babette rales um this is the lawsuit that was filed against not just Danny Masterson but David mavich the Church of Scientology International uh religious Technology Center and Scientology Celebrity Center International for what I generally call it the the the fair game lawsuit the stalking harassment intimidation but there's actually five causes of action in this lawsuit the first cause of action is stalking uh second cause of action is physical invasion of privacy the third is constructive invasion of privacy the fourth is intentional infliction of emotional distress and the fifth is loss of Consortium is how I believe that is pronounced okay so uh as Scientology does with most of uh lawsuits against it they try to get it thrown out using an anti-ap motion Scientology tried to do that in this case and the judge said denied and Scientology appealed that denial now an anti-s slap lawsuit I don't want to you know I've discussed this so much on this channel I assume everyone knows what it is already an anti- slap motion is basically saying this lawsuit is a frivolous lawsuit designed to prevent uh me from practicing my constitutionally protected uh free speech and and other constitutionally protected activity and it should just be thrown out now Scientology when it filed its anti-s slap motion against this lawsuit it didn't say that every single one of the causes of action was uh W every single one of the five causes of action was not included in the anti-s slap motion and so when Scientology files this thing and then it gets rejected and then they appeal it they are only appealing the specific parts of the lawsuit that were in the anti-s slab and what happened is normally the case would be stayed pending appeal and that is exactly what happened the judge said this case is going to be stayed pending this appeal but um but the Jane do and the legal team are saying you're on we understand that the issues in this lawsuit that Scientology tried to anti-sap and you rejected and they appealing we understand that those things we can't do anything with those until the appeal uh until the appeal process has run its course but there's entire sections of this lawsuit there's two entire causes of action that are remaining and we would like to move forward with Discovery and depositions on the causes of action that were not involved in the anti-sap Motions what they're basically saying is we the clock is a ticking we want to depose David mavich we want to depose Danny Masterson and if you look at the first amended complaint the list of Scientology officials and scientologists who could start being deposed we're talking about Mike Ellis the international Justice Chief Dave Pettit the head of the celebrity center International David mavage of course Russ Andrews a Scientology private a Scientologist who's also a private investigator um husband of Fran Andrews one of the famous missing Scientology Executives uh Carol Masterson Danny's mom uh Jane ones mother uh Donna Barstow Kathy gold it could get really interesting and really spicy so what I wanted to show you here is first of all I wanted to show you the five causes of action um this is the first amended complaint and this is what I was reading from so we've got the stalking physical invasion of privacy constructive invasion of privacy intentional infliction of emotional distress loss of Consortium and then we have the anti-s slap motion from Scientology that was filed this was back in March and basically so you have five causes of action and five plaintiffs Scientology in its anti-sap motion has to be very very specific about which causes of action which paragraphs in the lawsuit and for which plaintiffs it wants to anti slap and that's exactly what this document is they go through um all of the paragraphs and you'll notice it says they want this is for Jane do uh three who's publicly known as Chrissy Bixler she no longer um goes by janeo 3 uh they want the entire first cause of action thrown out and they possibly want the fourth and fifth causes of action thrown out based on the paragraphs that they have requested to be struck and that is the exact same pattern that you see repeating for all of the other requests they want a whole bunch of paragraphs stricken they want the first cause of action thrown out and depending on how the judges rules on the paragraphs they want the fourth and fifth fifth cause of action thrown out well guys that means that what is left just go back to this document here that means the discovery and depositions could move forward on number two and number three physical invasion of privacy constructive invasion of privacy and also I would have to double check the actual appeal that has been filed by Scientology because I believe in the judge's ruling when she threw out their anti-s slap motion she actually called them out for having misfiled their anti-s slap and I I might be misremembering this but I think they might have totally uh screwed the pooch on the on their request for the fourth and fifth um cause of action but that's proba that might be all wrapped up in the appeal okay the next thing that I wanted to share with you is that um one of the basis for the request that they're basically asking the judge can you reconsider you you put the entire case on a stay and we never really had an opportunity to argue for for why we should be able to move forward with depositions end Discovery in in a limited sense and I just wanted to show you their filing on that just to be thorough here this is the plaintiff's notice of motion and motion for reconsideration and they do explain here that let me see I I scrolled through this earlier so I kind of know what I'm looking for let me back out a bit okay I'm going to scroll down yep the court imposed a stay on the case in its entirety uh the defendant that's Scientology uh defendant's appeal is limited to the specific allegations and causes of action at issue in their anti-s slap motion and they go through each one of the plaintiffs and uh each one of the uh the things that Scientology tried to anti-s slap the court does have the authority to change its ruling on this plaintiffs were not afforded an opportunity to brief the scope of the stay and as a part of the evidence submitted in support of this motion for reconsideration was the entire transcript of the hearing from back in March which I had an opportunity to read through before this and it was pretty interesting and yeah it never even really came up at all they never had an opportunity to argue this at all and then let's see uh the other document I was going to share with you was basically kind of redundant so we don't have to look at that okay so this is what the hearing is going to be about it's going to be very interesting and I um I think that the plaintiffs would very much like to have as much support as possible in the courtroom tomorrow I know there's a lot of you out there in Los Angeles who have been paying attention to these proceedings not just uh realize this lawsuit is one of five outstanding lawsuits against Scientology and David mavich not to mention all of the legal proceedings that have been going on over the last six months uh or so uh regarding various protesters and protesting activities and restraining orders and hearings and anti slaps for that and all that kind of stuff so for those of you who have the time uh to go and the availability to go I just want to reiterate this hearing is tomorrow morning 9 amm Stanley mosque Superior Courthouse Downtown Los Angeles Department 50 W the more the merrier you guys okay as I was going through the filings on this I found something SC Scientology attorneys have failed to pay a fee and if they do not pay this fee in the next week their entire appeal in this case is going to be thrown out this is one of those embarrassing things that uh I just I don't know how does something let this slip through the cracks you guys look at this okay superior court of Los Angeles you can see Stanley all Bix it's the Bixler lawsuit Bixler at all notice of default to the appellant now you'll see the the appellant is the Church of Scientology International at all your appeal has been placed in default pursuant to California rules of Court da da da da da for the reason indicated below and will be referenced to the court of appeal for dismissal if you failed to correct the defect and comply with this notice by the due date indicated below okay let's see which boxes are checked failure to timely pay deposit for reporters transcript or take alternative action as required by da da da da da um failur to timely pay the $50 fee for holding the reporter transcript deposit in trust as required by da da da da da da da and the date that they have to fix this is uh September 6th now at first I was a little worried like I don't know could the entire appeal really be delayed by something as small as like 50 or $100 or $150 uh the answer may be yes and I was like am I letting the cat out of the bag if I you know mention that in the video um and and I checked with some experts in the area and they're like no Scientology attorneys have all been notified about this it's it's in the it's in the um you know it's in the official record so uh it's really just more of a of a funny mistake now it did occur to me like now hold on now the time has already come and gone for Scientology to have actually filed their appeal regarding um the judges ruling on this anti-s slap is there any way that they've decided not to move forward with that anyway I I checked the uh the second district court website and I actually found all the appeals have been filed and all the filing fees have been paid so it just seems like this is a little bit of an oversight I don't know a funny oversight if
