- Hi, I'm Brandon Naidu. I'm a criminal defense attorney here in San Diego, California. Today what we're going to be talking about is great bodily injury
in a domestic violence or corporal injury type of a case. If you're watching this video, you may have already
watched our overview video on great bodily injury. If you haven't, make sure
that when you're done watching this, go over and watch that one. Great bodily injury. So to sum up is like what it sounds. It is an enhancement to a
criminal charge in which a normal criminal charge has been
enhanced by the fact that the victim has suffered
a major injury to their body. What are some examples
of great bodily injury? Obviously something like a broken bone. That's almost always
going to be classified as great bodily injury. In domestic violence, domestic violence cases can enhance from what normally would have been even a simple misdemeanor
type corporal injury case, where there was some pushing and shoving, no fists were thrown, anything like that. But as we had in one
of our previous cases, there was a struggle. They happened to be at
the top of the stairs. And during that struggle, the victim allegedly slipped
and fell down the stairs, as a result, breaking a few ribs. What normally would have
been charged as a simple misdemeanor for the
pushing and the shoving without any hitting, our client was charged
with great bodily injury and what went from misdemeanor, likely no jail time and probation, our client was facing
several years in prison. That's what the great bodily
injury enhancement does. And also we'll add a strike
to your record if convicted. So it's very important that if
you're in a domestic violence situation where great bodily
injury has been charged, you need to give us a call immediately so that we can work with
you on assessing your case, analyzing it and coming up with the best approach to protect you. So give us a call, (619) 577-0868.
