a US prosecutor is now asking a judge to rethink her decision to toss out Alec Baldwin's involuntary manslaughter trial all because she thinks some evidence wasn't all that important after all New Mexico prosecutor Carrie morresy is claiming that the court was wrong when it said law enforcement purposely withheld key evidence according to morresy the evidence wasn't hidden on purpose but rather it was immaterial so apparently hiding evidence is fine as long as it's not too important good to know she's now requesting the court to give the case another look and bring Baldwin back to trial for those who might have missed it Baldwin was rehearsing on the set of rust in 2021 when the gun he was holding went off tragically killing cinematographer Helen Hutchins and injuring the film's director prosecutors have been arguing that Baldwin didn't follow basic gun safety rules and acted recklessly meanwhile Baldwin's defense was that it wasn't his job to check whether the gun was loaded with live rounds you know because why would the guy holding a gun need to know what's in it right this whole mess went to trial back in July but it didn't last long the case was dismissed after the judge Mary Marlo Sommer found out that some crucial evidence had been conveniently kept away from Baldwin's defense team apparently a former police officer Troy tesy handed over live bullets that might have matched the Fatal round but the crime scene text didn't even bother to link this to the rest case File can you imagine how hard it must be to connect live ammo on a movie set with an ongoing shooting case a real head scratcher judge Sumer didn't hold back either she ruled that the evidence was deliberately kept from Baldwin's lawyers and kicked the case out of court with prejudice in other words Baldwin's chances of getting 18 months in prison were gone and legal experts pretty much said it's unlikely he'll ever face criminal charges for the shooting again but here comes morisy determined to give this case another shot in her New Motion she claims that the bullets tesky handed over could have been bought at any gun store long after the shooting happened making them irrelevant to Baldwin's case so if those bullets weren't around during the actual incident then we're back to square one according to morisy the key issue remains it was still Baldwin's job to handle the gun safely her Motion makes it sound like it doesn't matter where the bullets came from and that Baldwin still should have known better so in other words no one really cares how the five rounds ended up there just that Baldwin pulled the trigger what's even more interesting is that morrisy isn't just stopping at the evidence she also wants Baldwin's lawyers to explain how they even found out about the ammunition tesy handed over to police it almost feels like she's suggesting that Baldwin's team has some secret info they shouldn't have and she's looking to build a case for a higher Court review apparently things are getting a bit messy behind the scenes and morisy wants all the details out in the open so what are we really looking at here on one side morisy is trying to argue that the case shouldn't have been dismissed just because some evidence wasn't shared she's focused on the fact that it was Baldwin's responsibility to ensure that he was handling a real gun safely live rounds or not on the other hand the defense could easily point out that it's pretty shady to withhold evidence and then call it immaterial after the fact after all if the evidence didn't matter why keep it hidden in the first place then then there's the question of how Baldwin's defense team found out about the ammunition is morrisy implying that Baldwin's lawyers did something wrong by knowing about this evidence or is she just trying to find a reason to drag this case back to court either way it's starting to feel like morisy is grasping its straws here the fact that this case was thrown out so quickly in the first place suggests that there were some major issues with how the prosecution handled things and now they're scrambling to recover on top of all this we can't ignore the big issue here how on Earth did live ammunition end up on a movie set to begin with regardless of whether Baldwin should have checked the gun the real question is why was there a live bullet on set at all this case has opened up a lot of discussions about gun safety in Hollywood and it's clear that there's a major problem with how Firearms are handled during film Productions if anything this case should
