indictment against Donald Trump by Jack Smith in the 2020 election interference case. So follow the bouncing ball here. The new indictment focuses on Donald Trump, the candidate in 2020, and not Donald Trump as president for four years. This in an effort to avoid that Supreme Court ruling on presidential immunity. Joining us now, current Trump attorney Will Scharf. Will great to see you. I just I can't get over the election interference. Early voting starts next week in North Carolina. And ten days later in Pennsylvania. So is this election interference? It's not even subjective. The answer is yes. Okay. It is, but I is there actually a case here or is this just another attempt to help Trump raise money and give something? Give the people on MSNBC and MSNBC, CNN, something to talk about? Yeah. So first of all, I mean, it is binding DOJ policy and has been for decades that you don't bring an indictment, you don't commit any overt investigative act within 60 days of a presidential election or any election, for that matter, as President Trump pointed out on Truth Social, the other day, we have early voting starting within the next week or two. So the idea that Jack Smith would be rushing this superseding indictment through a grand jury at this time, it really shows what we've been saying all along, which is that this entire campaign of lawfare is just about election interference. What's at issue here is the fact that the Supreme Court absolutely gutted Jack Smith's case with its presidential immunity decision that came down on July first, and he's now desperate to rescue it. That having been said, we've reviewed the indictment. I read it yesterday. There's still a ton of presidential, presidential immune acts and evidence included in that indictment. I'm sure it was presented to the grand jury. They still have massive issues here. We're going to be challenging this. I don't think this will stand. I think President Trump is going to have the ability to run for president as he deserves undisturbed, to the extent possible by this entire campaign of lawfare. Yeah. Did you see another indictment coming down the pike before Election Day? Did this surprise you? I figured Jack Smith would try something in this DC case. I mean, he invested so much into it to see it get just destroyed by the Supreme Court with both our immunity appeal and then the Fisher case, which was a January 6th case as well. I think we all assumed he would try something. The idea that he would rush this sort of an indictment through a grand jury at this time, though, I mean, it's just it's absurd. Speaking as a former federal prosecutor, this isn't how you're trained to behave. This isn't how you're trained to act. Jack Smith is a rogue prosecutor, and I think he needs to be called out for that. Yeah. And he's been enabled by Joe Biden, who's in charge of Merrick Garland, who ultimately is in charge of Jack Smith. And that's where we are. And that's just a fact. If Donald Trump does lose on November the 5th, how much exposure is there for the former president in this case? Well, look, all of these cases are baseless because President Trump did absolutely nothing wrong. And what we've seen consistently is that on Indictment day, the mainstream media breathlessly covers each of these cases. You know, this is going to be the case that brings down Donald Trump. And then as we get into court and fight, they collapse like a, you know, like a house of cards. We saw that in the Florida Documents case, which has now been absolutely dismissed, which is dead. And buried. Same with DC, where everyone talked sort of breathlessly about it. And then we got up to the Supreme Court on presidential immunity, and they gutted it. The unjust jury verdict in New York will not stand because of the numerous constitutional and due process violations that occurred there. In addition to the fact that, again, President Trump did nothing wrong and then down in Georgia, that case is on a slow boat to nowhere. So when you look at the entire litigation portfolio here, President Trump is winning. We are winning and the force is arrayed against him. Are losing and desperate. I think President Trump's going to win in a landslide in November. I think then we can finally restore some semblance of normalcy to the rule of law and to legal processes in this country. But regardless, this campaign of lawfare is failing, has failed, and will continue to fail. Will just 15 seconds. If I can hold you to it. Sentencing in the New York case, Judge Juan Merchan coming up, what does he do there? We've moved to stay. Sentencing Obviously, sentencing should not occur while we are challenging presidential immunity issues in that case, that's a motion that's currently before Judge Merchan. I hope he does the right thing one way or the other. I believe that we are going to be moving up into the appellate courts very, very quickly. I don't want to give away litigation strategy, but the unjust verdict in New York will not stand, and President Trump's rights will be
