got out there C four and we have three chairs so you need one more at least ladies you can go in another row right there come on we got two there one there we're bringing another one in we're perfectly fine you're all right we have aop with no one more one more no you're good okay you're good put there this is the door they usually not I don't know if you get hit we all like oh darn door open all right so we're going to go ahead and call this meeting to order um then start out with the hearing of the noise ordinance um we have a lot of public comments or public here so go ahead and we'll look at the changes first um so the main change that we're discussing is removing of article 8 which is the noise level limits with a decimal reading um if you haven't caught any of the other meetings this is being removed because everyone is breaking the law fir you mow your lawn you're breaking the rules you have a conversation outside your house you're breaking the rules standard desal readings and such like that well the other problem is it's impossible to enforce well because you can't yes if if yes you can get a decimal reader for six bucks however if if you make a loud noise right now that may be 10 on the decimal scale or whatever you know way up there but then 15 minutes later it's not there there's no residual there's no way to verify that that was in fact correct so you have a problem with what they would call a chain of evidence that's the problem with that correct so and I had a bunch of research on this and find it at but basically you mow your lawn you're over the desal reading you like I said you talk you're over the desal reading you do anything you're a des read um also doing some modifications on it for adding in um activities related to farm agricultural farming as defined as RSA 21 col 30 34- a which are exempt from noise ordinances per RSA 31 col 39 and those are additions to the new the exemptions would now be article 8 and you you're adding items 10 and 11 correct and then that would be it which is basically also number 11 is domestic livock and residential settings shall be exempt from the ordinance so chicken du those beautiful lovely animals who quack and Crow and make noise would be exempt from it as well um so we have lots of public um we'll first start with this s any comments from new gentlemen talk with the police department and on it well any comments no I think it's straightforward I mean I think it's one of those I don't think there's anything to explain I think if you object to it you object to it and if you agree with it you agree with it now that all right so we have lots of public here and I'm guessing most of you are here for this so we'll start with the right side go ahead and say your name where you live please uh Justin bony 48 Richmond Road and we're just here we have the motor cross track that my son rise that you guys have probably heard a bunch about I just want to make sure that doesn't affect anything we want to make sure you know we're all for getting rid of that decimal limit even though it doesn't apply to us up in the rural area one actually it would apply to everywhere in town okay so that's the hard part like I said it's kind of a dick that it's impossible for us Force but it's also ridiculously low for any type standard well any I I would ask the question that uh I Mr Baston it does it it clearly as the ordinance says it clearly applies to residential commercial industrial and public right but not but not the rural correct we're in the rural area so we're not here we don't have any problems we want to make sure we're not having any problems that would and with How It Was Written it was also written in correct for that because that would fall under public or under because residential yeah yeah I mean I'm not it's kind of one of those they wrong I think I think you would have even if you wanted it you'd have to change it correct which that's why the whole point of just was that during certain times though uh it was actually During certain times from 7:00 a.m. to 10: P yeah it's that in all premises and all Z the day industrial could operate 24 hours and they can't really no we can't you know that's an interesting point because when the mill ran I don't all you lived here long enough for that but I live I used to live in balker bille I live on Russell Avenue now but well the mill was running 247 you could hear the mill in Vell at night I mean it wasn't loud but you hear that you could hear the you could hear the machine you could hear the humming probably lowed for the people living around it well I'm sure it was but in as sleep though after a while well and that's when you know when the mill shut down you know what the hell happened my ears are no longer humming all the time way before my time but yeah that's the hard part about an ordinance that you can't enforce but it's also written that part is just it was added on later on yeah I know understanding like construction stops at a certain time and you can't do it after a certain time at night I can see during the evening in night time but during the daytime I don't know how you enforce a de sound issue when people have to pound hand nails and build houses and that's that's going to go over the deci level right there well and like I said mowing your lawn even an electric mower which so now you guys are sound like Massachusetts you know everything's electric mowers and electric weed whackers now even those are above the desal reading and that's why it's like this that part of the desal reading made no sense the rest of the oran Mak sense be quiet between 10 and 7: except on Sundays which is 10: to 9 I think that's one of those weird I don't that part but so it would still be a 10 to 7 yes that part will still be in there where it's basically quiet you know don't don't go running your lawn row at 10 p.m. you know that's what this is about for soul fan this basically is be nice to your neighbors and you know don't make too much noise again it's all there was some complaints about domestic animals people had chickens and their roosters and the roosters were crawling at 6 that that falls under if it's a dog barking all night there's something typically that means there's something wrong and then the police could get involved with that and say hey take your dog inside take care of it things like that but if it's a constant thing but people were complaining even about chickens Ducks roosters and like those are domesticated farm animals that you can't shut them up you said s in the morning s at night 10:00 at night so in the morning to the night time no no no during 10 p.m. to 7 all right that makes a lot but this ordinance if you like stop shooting your guns before 10:00 yes uh but if you'd like to read the the the part we're moving I'm just saying Richmond weird they let you fire weapons 24 hours well and that's a hard thing to enforce someone shoots it unless you know it's your neighbor and you know exactly you can't again it's something that he has to deal with because I know there's plenty of people who fire off G at all hours of day and night all right so anything else no I just want to make sure he can ride his four-wheeler still during those hours do you have anything I guess I don't uh uh I mean it be nice to have something on the books such that you can fall back on but you know my big scrip is the ATVs and the and the dirp bikes that go in the woods you know they that when they come out of the woods that first 100 yards is pedal to the metal and well and that there are speed limits so if they're going over the speed limit we have to call fishing game that's a fishing game and then even though it's on the road they come out of the woods and they're flying by it would be fishing game and fishing game will they will come out and they will sit there and ticket people yeah I know and and if you don't have the ohrv stuff they they fishing game doesn't play with that especially if there's enough people who complain so I guess regarding this I don't really have much the way comments my grandson just making sure he can dite with them I got a whole crew all these all these guys are with me the support support all right other one out there any comments with me I'm with him they prepared that's how you do it I think we're all in agreement to there should be no sad ordinance we agree well there's an ordinance but it's it Hason common sense right we're super respectful that we shut it down by 6:00 he goes out a couple days a week and rides for an hour so he's making noise in our yard on our private property for an hour couple times a week the the history of this ordinance which I I want to get into too terribly deeply but there was somebody who didn't like their next door neighbors rooster mhm he had chickens but he didn't have a rooster yep rooster kept coming over and going after his chickens and if rooster doesn't make that much noise now I don't know I live in the house the person on Russ Avenue I was fine with it you know we live in the country It's A Beautiful Noise well it seems like an appropriate place for yeah like I said I live I live in the house that the the original person who put had this put in lived in and I I mean here I hear the road NOS more than I hear the animals around me he's still the same neighbor and he's still got chickens right yeah he does does he give you free eggs I don't ask probably could get some yeah just complaining about us rooster all right so anything else I will entertain a motion to yeah on the uh I have some questions about the uh the D we're not there yet we're not on that part yet this is this was a that was a hearing on that one yeah this is a hearing we had to put out to make sure everyone was good on so I'll entertain a motion to approve as amended so move all right any further discussion well my question would I think we need to close the hearing and then go into the selectman's meeting and approve the coordinates okay I don't think we do that in the hearing okay so we move to adjourn the public hearing all right all the excit which there was so much excitement in here for the noise ordinance move that we approve the r Visions to the uh noise ordinance as proposed and and handled as a public meeting public hearing uh minutes ago debate M Mike effective effective second all right uh any further discussion all those in favor I I for clarification by immediately Jeremy I mean 81 2024 so the noise ordinance passes um we are going to can you go ask what it's about needs to talk I know what it's about what it'll be quick no which cuz you got to make a motion reputation yes the reputation I make a motion to go into nonpublic under 91 A3 ran numeral 2 C matters which it discuss in public would likely effect adversely reputation of any person other than a member of this board unless such person requests an open meeting this exemption shall extend to include any application for assistance for tax abatement for waiver of a fee F or other Levy based on an inability to pay or Poverty of the applicant second
