Defenses to Corporal Injury On Spouse Charges (PC 273.5)

[Music] when someone comes in our office and says they're accused of corporal injury on a spouse they're obviously worried about going to jail and all the other consequences what people need to know is there are two critical defenses that we have raised successfully over the years to win these cases the first is self defense if a person is coming at you a spouse to co inhabitant and it looks like they're going to punch you you have the right to use reasonable force to defend yourself in that circumstance that can include pushing the person away if the person falls and injure themselves while you're defending yourself in such a manner you likely will not be convicted however the force must be reasonable if a person comes at you to push you down in the sand you can't take a gun out and blow their head off that would be really unreasonable force and we would not be able to use that defense successfully another defense to this charge of course is accident many times people who are married co-inhabitants they are in the process of a tussle or wrestling or something of that effect and sometimes it gets heated and if the actual injury is not caused intentionally but because of an accidental injury that is a viable and winnable defense in many cases we have handled thousands of cases of corporal injury on a spouse and we receive outstanding results in many cases we urge you to hire us if you're accused of this crime [Music]
