Now right to our top story this morning those same jurors who found Robert Ellis guilty also considered his punishment they heard testimony from victims family members and from the defendant. >> If you could please give face the Jets approval. The tragic and brutal taken of his life has resulted in a loss. I don't call recover. >> The jury came back with the suggested sentence life with the possibility of parole after 20 years. The judge has set a date for sentencing for October 16th, she'll decide then whether or their Willoughby and hence minutes to the punishment. Now we've got some new reaction this morning from the Las Vegas review Journal where victim Jeff chairman worked of the journal saying quote today a Clark County jury delivered a measure of justice project gamma and we hope it brings some solace to his family friends and colleagues, Jeff was killed for doing the kind of work in which he took great. So many of our viewers noticed you 2 and your advocacy with those very bad facts you had to contend with and so I just want to start by kuz mending you on on the trying of the case and the great lawyering that you did you created a lot of doubt that was evident in those jury deliberations. So let's start there Robert rescue but you closed your was sensational. >> In pointing to the hair. >> The hair and and the profile and all of that it seems that you got the job, he hung up on that for days your reaction. >> I thank you so Julie Michael I worked real hard resent Robert's case, the best we could under the circumstances obviously our job is to create that. I mean you know these these trial shouldn't be like a speeding train getting to their destination of a conviction so we work as hard as we could with it facts that we had present the strongest defense possible. >> It was evident that you did and he didn't make it easy, you know him testifying, I know that but you can't devolved into the client a communications with him, but everybody watching and analyzing was saying surely this was against better advice of counsel, but he did and it seemed that he and did a lot of the great work that you both did I'm Michael let me go to you on this police mug, the understanding is that you both were retained. I would like at the 11th hour right before this trial. Even started is at right. >> That's Originally the trial was set. Earlier this year robber was teen on the case and we're going to come in and just try a case when it was set to the issues with the review Journal all and the privilege of Mister Gibbons sources and devices that's why was continued so much so that in we're on this for several months leading up to this court date. >> Well it for not having a lot of time to prepare of there was a lot to go through a lot of evidence this jury had to consider it seemed based on their questions that what they were hung up on was that video and Robert which you pointed out I want to go back to a clip from your clothes that where you're pointing out of the suspect having hair. >> You have this evidence wasn't part of his presentation but has been provided to you. With the profile was that look like on the top of the headaches May 2 other side hair. We she measured 1000 gave testimony from the witness stand. Does that profile matched the profile in that vehicle. And it is no secret a massive ball. >> OK Robert take us kind of inside when did you notice this when did you kind of device the plan to go after this in close. >> You know you we are aware of this days before closing but we've got the most effective point to bring it forth to be a close in that way the state could not but it you know every time we can I mean that these cases in most cases we try or sexual assault cases. Racketeering cases murder cases we bring a team approach it was myself. Michael Horvath and Josh Berry of manifest right miles we try these cases together and oftentimes you try and out analyze the state or the federal government to try out investigate each and every case. This was one of those grenades that we wanted to just drop at the end to try and stop they're they're proceeding forward with getting a conviction so we knew about the several days before closing but we've got the best high time to present it would be at the very end. >> I was so smart so smart I have another clip here let's take a look at where you're talking about how the room was no blood found in Robert Ellis's vehicle. >> There was no blood or DNA evidence concerning Mister garment industry tell us is home. None of that would implicate Mister tell us there is not a positive identity Haitian of the subject vehicle or Mister tell us at the scene. >> Very favorable fact for your defense team and right before Robert Ellis testified in Michael go to you on you all have done a such a great job. >> be what I want to not creating a rather substantiating the alibi with the cell phone expert talking about where he was and and not being there at the scene and you couple that with what we just saw no blood in the car. I'm Michael at are you all did such great work there I can't imagine what it was like sitting there with then Robert tell us getting up there and and doing it all and having the testimony come in on across the message from his wife the where are you text. What was that like what's it like it as an attorney you really have a client can undermining your work right there in front of the jury. >> Myself Mister dress Commission we're talking with our client you know obviously in every case you. You advise your client of the pros and cons the pitfalls of that if someone testifies of the defense the defendant testifies. Mister tells is well aware that if he testified that there could be good things and that things and he ultimately made that decision and it's the client's decision to do that and as defense. You know as we go in and we do these things and Robert did a great job on this case on leave. We have to deal with what we're given and what the client's wishes are. >> How is your client doing this morning. Clearly didn't take the news. Well yesterday. How is he today Michael. >> We spoke to him briefly yesterday are we anticipate going to see him at some point today due to discuss potentially the next steps what he would like to do that are involved it would be so we can have an update on that may be late. But at this point you know we did get a chance to talk about and talked with him at lakes. >> Sure sure and again certainly want to acknowledge I know that their covid privilege communications that you you you just can't legally ethically. When we saw him testify in narrative form. It right away. We started in with analysis I I said you know it seems very apparent to me that these are 2 very at the lawyers who do not want to violate any at the goal rules and they're going to have him testify in such manner is there anything. And all you can share with us or anything else you would the public to know about without violating any privilege anything more you can share Robert about that situation. >> Well obviously it's every defendants right to testify or not testify. I'm really glad to see that you pointed out obviously the communications we have Robert Ellis are privileged. You know we honor his right to testify his right to present his case, I mean generally defendants don't want to face juries and tell their story to Robert Ellis is an articulate educated. it's always his choice ultimately it was his choice to present his side of his version of the facts and that's what he did I'm not really going to comment on why was narrative form, but nonetheless he was able to get his points across to this church. >> Right it is as is his right as you is there anything else that you would like the public to know about this case anything that maybe didn't come into evidence couldn't come that you would like to share with us about Robert or Michael either of you please. >> You know Roberts keep going to continue to fight this He has a great deal of results. That's one of the great things about our American justice system is that those that are accused of a serious crash times are all crimes have a right to fight their case we have this due process right to confrontation right to present evidence and file motions to exclude the state's evidence. This is a very important step in the justice system, dissipate there will be many steps that will follow this one. >> Sure will you be staying on his As he seeks post conviction reliever perhaps an appeal. >> Us very good question that's something we're obviously going to have to discuss with him. We try cases that's kind of what for more live group is focused on He obviously has a right to appeal we anticipate in pursuing an appeal that's one of those things that are yet to be determined. >> Right weight is very that you to do trial work and a few needs to get somebody does primarily appellate work to handle that we would understand your trial skills were tremendous both of we would love to have you to come back on some day after you've gotten some rest and give us some analysis on another case that is not yours how's that sound. >> Thank you so much for me
