that was three and four years ago you drove the car three and four years ago right yes and he took my car away after the divorce and I felt like he did no he took the car away 2 years ago I understand when was the divorce finalized in 2010 he took the car back in 2009 yes were they separated then yes they were and the car was in his name yes it was so now if you didn't sue him then why are you suing him now I just felt bad to sue him he's my stepfather and he's done so much for me and well if he's done so much for you then why are you suing him now because I made over $7,000 payments on the car and it was a gift to me for gradu it wasn't a gift to you you were making payment you can't have it both ways you can't have listen to me you can't have a gift and making payments on it if he put the down payment on the car and you were making payments that was a gift of the down payment not a gift of the car because you said to me you were making payments for 2 years that's what your lawsuit payments for February March and April nobody at the time not at the time who made the payments in February March and April February and March uh it was 2 months behind okay and who ultimately made those payments nobody I actually did your own of course of course the loan was in his name the car wasn't his name what I don't understand is if you had a nice relationship with him put the graduation card down you have to have a theory either it was a total gift which it clearly was not the down payment was a gift and the understanding was that you had with your stepfather was that you were going to make the payments on the car every month which you did for two years until you lost your job and couldn't make the payments anymore and he repossessed the car that's 2 years ago you can't wait until their divorce is final that's a long time I still don't understand why you're here if the reason you didn't take any action before was because he helped you and because you cared for him what's she does what does she do she is an engineer who else lives in your house other than you and your mother I live by myself now actually when did you move out of your mother's house February 14th for February 14th who's living in your house uh my mother my stepdad my older brother my younger sister and two younger siblings male and female your mother work hard yeah she is working all the time she works hard to support her family yes she does how do you think your mother would like it if some guy took money from her um probably didn't wouldn't like it at all right now how much money did you gave me one week's notice that she needed her car back again yeah your mother needed her car back so you needed a car to go to work to go to work and see her is which is why she gave me the money so what did you buy I got a motorcycle where is it now at my apartment right now well good you can give it back to her okay do you understand what I'm saying to you you have to do the right thing I do you you're not supposed to start out at age 20 trying to do a fast step around your obligations if you didn't have any money to get a motorcycle and you needed some mode of transportation to go to work and your mother couldn't Advance you the money to go to work you had already borrowed some money from your mother is that right um a is not an answer had you already borrowed money from your mother I owed her the money before I knew that I would have to get myself a vehicle how much it was a few hundred what did you take the money from your mother for I can't recall did she expect it back from you yes she did did you pay her back yes with whose money with her money whose money Jessica's money as an offer to help me out so you paid back your mother the engineer by taking money from somebody younger than you are to pay off your obligations and to buy yourself a motorcycle does that sound reasonable to you I never asked for the money does that sound reason I don't care whether you all parties in the matter of Barnes versus Espinosa step forward please 24-year-old Roxanne Barnes is suing her former roommate 24-year-old Sarah ES penosa for breaking their apartment lease Miss Barnes the defendant was a roommate of yours according to your complaint you signed a lease in August of 2010 how much was the rent $689 total and you were reach paying half of that rent your complaint alleges that she moved out and she owes you rent for the months that she wasn't there yes ma'am when did you move out Miss espanosa I moved out on the 23rd of March and you paid March's rent yes ma'am so you have April May June July in August 5 months that if you live there you would be responsible to pay 34450 is that correct yes now when you moved out in March what precipitated the move and when you gave notice to Miss Barnes that you were leaving I gave notice to Miss Barnes probably the day before I moved out and what did you tell her I gave her I tell me what you told her I'm sorry I told her I was going to be moving out and I'm going to be paying the next month's rent until she finds a roommate to move in and take my room I thought that would be a lot better than me finding someone to take the room I thought I'd pay the rent and give her the option to find someone that she wants to live with and and before the first of the month came for me to pay that rent she yeah when did you file the lawsuit I filed the lawsuit on the 25th of March of March why the reason why is because she sent me a text message saying she had already found a place and she did mention that she would pay rent for April and I have the text message no no she said she would pay rent for April and she didn't pay it she didn't pay okay so that's $344.00 minimally for April now what efforts did you make to get a new roommate first off the reason why I filed so early was because I did not get a response from Sarah from the 20th until it's irrelevant she owes you minimally that and if you don't find a roommate are you staying in the apartment I've moved out when did you move out on the 15th of April where did you move to I'm staying with a friend what amounts of money did you pay to the landlord in April in April I paid my half of the rent which is 3.45 and and then because her half wasn't paid I ended up paying her 345 plus late fees I'd like to see that you paid her half and her half with the L fees were $455 correct yes ma'am and this is your rent now what are the fees do you claim you PID to the land Lord the fees that are due are a rent concession chargeback because we moved in with a rent concession of $689 do they have a judgment against you no have you been contacted by their attorney no so so far she owes you $455 where do you work um I work at a coffee house you work at what coffee house it's called spider house and how long have you worked there I've worked there for one year you worked there as um bartender Barista and you paid a salary plus tips mhm so the landlord can enter a judgment and take whatever you owe right from your salary correct spiderhouse you know where that is yes great now when the landlord comes against you for additional fees for moving out cuz she moved out she couldn't do the whole thing herself the landlord will probably take care from you and are you employed no I'm a full-time student it may just be that the landlord's going to come against you for that whole amount of money your honor I made a phone call to the apartment complex and I made arrangements with them to pay off what I owed them for my half of the rest of the lease that's great so you have no problems so all you owe her is $455 that she paid in April how easy this is wonderful charge for the plain to from the amount to $455 thank you very much are excused step out we went to high school together we became really good friends when I first moved to Austin and then our relationship kind of fell when we started living together we leave high school well in the past I was um in not Hall and stuff so um I went to an adult school to get U my GED but where did you work 2 years ago uh I believe I was unemployed two years ago where did you work three years ago uh as a pizza delivery for whom um I cannot remember the the name how long did you work there I worked there for about um month or two now I want you to listen to my question very very carefully cuz I check on all my facts okay since you've been 18 years old now you're now 21 you've been living on your own yes uh yes 18 you weren't incarcerated when you were 18 uh I did uh do 30 days when you were 18 not when I was 18 but after after I turned 18 I did for what um for a DUI that wasn't your first DUI accident then if you did 30 days well I wasn't paying revenue recovery so it was for outstanding warrant that I did 30 days for the DU I want to know since you're 18 I want to know your work history I have a month as a pizza delivery boy that you can't remember the name of the place basically I basically I did a lot of work with my dad uh he has a landscaping company but that was under the table and I worked for him a lot when you say that was under the table you mean you were paid in cash and didn't pay any taxes yes I and so how long did you work for your father uh was off and on but I want to know where you worked to support yourself since you're 18 well basically I was looking for work at the time now how long did you work for Mrs Lynch for about two months two months so in your whole life time I have a work history of at best if I believe you with for the pizza business three months two months pay careful attention to me two two months for Mrs Lynch cuz actually I don't believe anything else yeah this is what your lawsuit is you went to work for Mrs Lynch she has apartment complex you were hired as a handyman according to your complaint during that two-month period you hurt your back so you applied for workman's compensation you following this sure you got it got it applied for workman's compensation and because Mrs Lynch didn't report the requisite number of hours you weren't given all you should have gotten from workman's compensation you were only given how much a month just tell me how much a month were you given from workman's comp uh a week 380 $380 a week you got from workman's compensation is that right yes and for how long did you get $380 a week for about 3 4 months is it 4 months that you got $380 Mr duu um I can find out the exact dates yeah good let's find out the exact date want to find out how much we have to pay you for somebody who worked two months in their entire life how long we paid you for workman's compensation for an alleged injury that you got within the first 8 weeks of your LIF time employment the injury was March 3rd of 2010 and uh I received them all the way up to 1029 2010 well the injury wasn't mared March the 3D well it was a week before that but that's when uh I reported it to it was a week before that according to you was in February yes right so you started to get just a second so you started to get workman's compensation $380 March April May June July August September and October sorry um every two weeks that I would receive 380 biweekly yes March April May June July August September and October for eight months yes so let me figure out how you did this this is really lots of smoke and mirrors and your entire life you worked two months and we paid you for 8 months well I worked a lot since uh well with my dad I don't want to hear about you as far as the US government is concerned you didn't work for your dad at all yes and so what you're suing Miss Lynch for is $5,000 for wrongful termination so far am I correct and because you want more money from her because because she only said you were a part-time employee you didn't get as much money as you should have from workman's compensation that's your lawsuit right no well do you tell me what your lawsuit is you want me to read what you wrote 1,000 for uh lost wages from workman comp that I said both I want the defendant to pay me the difference owed on my workman's comp claim 1762 and punitive damages for wrongful termination $3,238 yes you got three minutes of my time because you understand where I'm going with you yes basically basically uh after I was working for them uh we agreed on $10 an hour at $40 firm so that was a pretty good offer I took that up uh after working for her um I was hurt on their job lifting appliances refrigerators Furniture up and downstairs I was hurt so I didn't go to workman's comp I never been hurt on the job before you never worked before you know mean you never went to workman's comp before you never worked before you worked for your father under the table you worked for HFF for two months period yeah so I I went to my doctor cuz I have Kaiser medical insurance myself I went to who pay for your medical insurance who pays for it how did you get Kaiser insurance I've my mom works for the state so I've been under her insurance great what in America keep going keep going I want to tell you the sympathy is pouring out for you so I went to my doctor to um basically get treatment for the back injury that I had uh I had a bulge disc in my lower back a what a bulge disc is basically pushing on a nerve through my left and how did you fix that you can't just fix it sure you could fix it had one of those myself go in and you can suck it right out yeah snipping it and stuff like that well you can do a whole bunch of things to it you look pretty healthy to me yeah it's uh look like you work out regularly I only lost 20% you look like you work out regularly sir and I can tell you know when you're working out got a husband who works out so I can tell when you are gym oriented you know what I'm talking about yeah keep going the only part I can actually work out is my basically triceps oh I could tell what you're working out sir and all this happened in March of 2010 how much did you work out between March and October I only go probably maybe two times a week listen to me I'm going to help you out here I'm going to be helpful to to get away and then she reached out and just started putting her hands on my neck and she was strangling me and you'll see in the video If it hasn't been altered that I was doing this I'd like to see car on the hood of what car on the hood of her car cuz after she started chasing around the parking lot while I was on the phone with the police they told me give her her phone back you cannot do that so I put it on the hood of her car ma'am the battery and the back of the phone were in separate places all over the parking lot so I did have to hobble over and grab these different parts to put them get it or you can just bring her tomorrow with the stuff that was a problem what was the problem either leaving her without for stuff are going I guess she didn't want to take my daughter back with her like cuz this my week I guess she was thought I was trying to push my daughter off on her for the week not not the case at all never have a problem I kept my daughter anyway that night you know anyway we argue I put my daughter back in the car cuz like I said didn't have the supplies for her just a minute so you had taken your daughter out of the car yeah I when when they pulled up I was taking my daugh I thought we were going to I didn't know we were going to argue I thought we going to go in the house you know what I'm saying everybody have a little good time so you took your daughter out of the car and you were holding her in your arms yeah and then you had this discussion about where her clothes yeah and she said I don't have the clothes so then you said you put your watching that's when I tried to go back around to the door to get my tablet she locked the doors the back windows were down from where I was driving I started reaching through the back window to try to get my tablet she rolled up the window on me and started bagging back with me hanging out the window got up she stopped I got out uh never got my tablet and meanwhile this is all happening in front of the threey old yes did you ever get your tablet I winded up getting it either the next day or the day after that because I told her I called the police on her okay so she drove off with the tablet yes ma'am go okay so he his family invited us to a barbecue we're bar before we even left to the barbecue the reason why he drove our daughter home cuz he had an attitude I don't know why he had an attitude but you can just since he did so that's why I rode with my brother back to his house to his mother's house to continue the barbecue cuz the the food wasn't done yet cuz we got kicked out the park cuz the Park closed at 10:00 so we got get to his house me and my brother pulled up first so they pulled up and we all got out the car he came back up front and I asked my daughter asking for juice and I said do you she was asking do they have any juice in the house and he ignored me I asked him again and he said no we don't so I'm like okay well I'll leave the baby with you I'll go up to the grocery store real quick get her some juice so she can have some for her food he was sitting there on the porch smoking a cigarette and out of Lily out of nowhere I'm not doing this anymore I'm like okay like he just start going off start calling me out my name not doing what anymore I don't I don't know he just he literally out the blue he was sitting there smoking his cigarette you can tell on his face he was thinking about something so like I said he just out of nowhere said I can't do this anymore it started going off like okay whatever so I went to my car me and my car I'm trying to pull off he put his arm in my car and try to take the keys out the ignition so in event doing that did he say my iPad is in the car or my tablet no he didn't say just a second okay was it it was it it was so yeah I did find it cuz it was dark it was it was late it was about 10 11:00 when this happened so I didn't see the tablet so I guess he left the tablet in my car when he was driving I didn't take it from him but he was trying to take the keys on my ignition and he's sitting there just yelling at me saying just call me out of my name so when he was doing all that he locked the steering wheel so my brother was trying to tell him to move so he can fix the steering wheel so I can leave so in the event of him trying to like I'm trying to get out he keeps closing the thing like this to keep trying like keeps closing the door so I can't get out the car and my brother's telling him to move he wouldn't move so finally he went in the house my brother fixed the steering wheel and it was just in this in uh neutral so he fixed the steering wheel so I'm leaving the baby she's crying to stay with her dad so I'm like okay you can stay with your dad so I gave him the diaper bag no I didn't have clothes in there but I don't feel like I should take care of my house and his house is your daughter get your clothes for her house so I gave him the diaper bag with a couple diapers and some wipes in there I gave him that and I send the baby to her uncle to give to him so I can leave he came outside he pulled my gas tank back and tried to put a lit cigarette in there and so I luckily I backed up fast enough for him to like he jumped off and I drove away and so he called me a couple times I didn't answer the phone and he called my brother well my brother was still there my brother called me and all you hear him in the background screaming and yelling and going off stuff like that and my brother asked me you want me to do with the baby I'm like it's his week just leave her there he's with his her dad she's safe and just come home so can you tell me why we're here he damaged my car and I want him to fix it what did he damage on your car the gas tank he he scratched the paint for a month and then so in June now we're talking about June yes so now in June you're no longer working yeah he just quit when you're no longer working I believe that's around the time I got at work working and she had I assume accumulated some money because you accumulate this kind of money in either a savings account or a checking account that would account for more than her share she lived with me from April until December 1st no she lived with you sir from June June she was in rehab in May she lived with you in June June she started to give you thousands of dollars my question to you is did there come a time when you finally got a check from disability no your honor from any sort of compensation going back to work just going back to work did you ever get a large check oh yes honor conducting a survey of your property I happen to think that that's always a very good idea you are a new neighbor and if there are any issues with regard to the property and the property lines you should conduct a survey similarly if you have an issue with a neighbor to protect your property and the fence that she built is in the rear of your property yes ma she contested the first survey that the post has broke off at the bottom when they um installed the fence post on her lot it damaged mine and at the same time they cut the cable line the main cable line was in that area and they cut okay well where the trees are at is where I tried to originally build my fence the the plain if was with my neighbor and telling my neighbors that those trees per her survey were not on my actual property line that they were the neighbor's property that they were on Whose property my neighbor's property somebody else's property not hers correct so she was informing them that they weren't so um that they were not your trees to take down correct they they belong to some other neighbor based upon her survey yes ma'am and and as I was trying to remove the trees the plaintiff and the neighbors got in the middle of where the tree company was there trying to remove the trees and and they could not remove all the trees they stood in the way of their work okay because according to to her survey those trees were on a neighbor's property line yeah but it was incorrect they were not for the survey just yes yes ma'am okay anything else I do have a video showing where they were trying to get in the way of the fence and everything being built I don't care okay my sense is that these people are not erratic nuts that there was a legitimate belief that those are not your trees to cut down and I assume that you eventually cut down the trees most of them they're still half there I couldn't finish the work I paid a tree company so that you did not cut down the trees that are contested is that Moss prior to leasing an apartment with the defendant had you known each other sort of uh tell me a sort of so we met one time uh about a year prior we have mutual friends one of which had asked me to get ordained to marry her and her husband so I flew in town to do that and naen was there at their house when I flew in we saw each other for a few minutes and that's actually the only time we've ever met person and there came a time when you were looking for an apartment where I was looking for an apartment in the Salt Lake area and where had you been living in Seattle and where were you living Miss jury in Salt Lake City you were looking to move yes so other than that onetime meeting when you were officiating at a mutual friends wedding you hadn't met before but somebody suggested that you were looking for an apartment you were looking for a new apartment and perhaps you could rent an apartment together yes that that's fair statement in fact yes and in what month and year did that happen it would have been in uh October of 2020 that this Arrangement sort of came to be like hey maybe you should see if n but you did in fact sign a lease together who found the apartment n did you did prior to signing the lease Mr Moss had you seen the apartment no um no was the answer did you ever see the apartment other than videos or photographs of it no I never prior to signing the lease correct also correct correct on what date was the lease signed on the 7th of uh November of 2020 the rent on the apartment was how much it was 585 a month each $1,170 your honor so 585 per month each you both signed it on the same day did you move in I did on what date November 8th and you were still in Seattle correct did you ever move into the apartment never and that is also correct correct because for whatever reason you decided to stay in Seattle correct is that work related or socially social and then you contacted her and told her that you weren't intending to move in correct but that you would continue to pay your half of the rent that also correct correct your honor and you were making a direct deposit to the account to pay the rent yeah it was an automatic payment from my account to the rental to the rental office to the rental office then you came to find that Miss jury had stopped paying her portion of the rent when did you stop making payments on your portion of the rent in January so you paid either full or partial for November because you moved in on the 8th and you PID December's rent correct and you stopped paying rent in January why I lost my job in December of 2020 so I'm going to outline now what this case is about yes Mr Moss continued paying his half of the rent until you found a roommate correct and you found a roommate when I believe I found him in February and he he moved in in the month of March and started paying his half of the rent so you didn't pay rent January or February correct two months correct and you had no work correct when you found out that the rent wasn't being paid according to you in order to not impact your credit you spoke to her she said I don't have a job you said I can help you out I'll send you money m is that generally what happened then I'll get that's generally what happened um but there is a little more detail to I'm going to let you get to the details all right and you want that money back the money that you Advanced her in her time of need which was how much in total the total is $3,360 she did at some point pay me $300 back so the amount I am seeking is 3,60 okay are those figures accurate yes and he gave you that money not because you were good friends cuz you were a relative he had met you one time right and he had in fact said to you I will continue to pay my rent even though I know you from hold in I will continue CU I signed this lease until you find someone to get me off the lease that's correct your honor and your defense it seems to me to this action m is that he was really trying to scam the government by depleting his bank account so we could collect food stamps or whatever no and as a result of that because he wasn't being honest with the government you shouldn't have memory let's start with you contacted the portal and you found out she hadn't been paying her rent that was in January correct January the 2 and January she hadn't paid rent and you called her and she said to you she said to me that she didn't have money to pay which I was aware of because she had previously told me that she uh had well okay I was aware that she had lost her job I was just a second how did you become aware that she had lost her job because we were friendly with each other we were talking several times a week via Facebook Messenger fine you knew that she lost her job yes and I assume you knew if she lost her job and you was speaking several times a week let's be very careful this isn't just calling the pay portal and finding out that this stranger who you met once wasn't paying her rent you were speaking and you knew that she had fallen on difficult times and I did um I didn't don't go up here right here I didn't know that she wasn't going to pay rent on time no there a second on you didn't know what on the second was when I found out that the rent hadn't been paid I on the second of January the second of January just look at me m on the 2nd of January you found out the rent hadn't been paid what did you do so I called naen to ask about it and she told me that she didn't have the money and so I said okay I have these extra funds because I at the time was also unemployed um I had been taking payments apologies um unemployment payments and then the co payment and what the extra payments for Co on top of unemployment because this was 2020 welcome to inflation 101 right so all of my payments had been late and had come in a lump sum so that is why I had so your unemployment and your covid funds yes came in in one lump sum correct and I want you to think very you sir I'm really not buying this whole story you're living by yourself with a roommate the roommate moves out your girlfriend had a terrible car you don't live with a girlfriend but you bought her car you didn't have a car but you bought her a car I had if we need to back it back it up I had given up my car in a a um bankruptcy earlier in the year because of in whose bankruptcy my your bankruptcy that is why I didn't have getting better all the time Okie do it was an interesting year that doesn't mean you don't owe money it just means I have to know the characters that I'm dealing with I understand your honor okay while you were going to the program which you said it was in person were you getting any government assistance that was connected to this trade school I that's either unemployment people were unemployment for years during covid when they cut me off December of 2020 they did not reestablish my claim I I kept applying and it was denied so I don't know why but it was what kind of work do you do now I work for customer service okay and the trade school that you wanted to go to was to prepare you for what to be an electrician was what I wanted to do an electrician yes and was this an online program no this was in person where um it was in Seattle and how much did they give you to go to that program they didn't give me money to go to the program uh but the program was free of charge okay so the government pay the tuition uh I believe that well somebody pays the tuition sir yeah yeah so the government pays the tuition m and while you were going to the program which you said it was in person MH how were you supporting yourself so were you getting any government assistance that was connected to this trade school I that's either a yes or a no yes I applied for food stamps and got food stamps that is what I got so you applied for some sort of a assistance while you were going to this trade school which you're not practicing now then you're not an electrician that is correct and in order to apply for food stamps you have to have a certain amount of money is the maximum you can have in your bank that is correct okay so that's the fraud you're talking about that's why you gave you the money yes ma'am okay I mean it's just a second I also gave her the money because she was going to need the the money for rent like it was one of those situations where it was mutually beneficial for me to give her the money but it wasn't you're looking up at the sky I understand what happened so I I wasn't going to have any way to support myself I needed something to the the $2,000 was going to cover the rent for my place and my place in Seattle and my place in Utah and then I wasn't going to have anything I understand that it became mutually beneficial for you to advance her the money so that your bank account would have lessen it so that you could receive assistance and also get free tuition at a trade school that you didn't use my intention was to use it and I changed my decision ision later that's do you think the trade school charged the government once you enrolled in it yes yes of course they did and you know how much the tuition was in the trade school yes you have to know no it was free to you but it wasn't free to the government the government pays $1,500 was what I was made to understand baloney you people really somehow deserve each other but you owe him $3,000 Madam judgment for the plaintiff we had done this court is a journ I'm a little bit uh shocked to be made out as a a government scammer I mean I lost my job and I wasn't able and he bailed on the the lease that he signed because that wasn't uh ever my intentions I mean I was alone I had lost my job I just didn't have any support definitely careful can because people are irresponsible and don't create a will it is likely that you will have part of the proceeds of this house likely only because if your mother passed away and and if she was in fact married to your father or lived with him at that time in California if there was a common law relationship and they did have children together then you as a offspring would be entitled if there together we were both looking for a place to live so um since we both needed that we found this apartment together two bedrooms correct and you moved in with animals I correct I understand from the complaint correct cats yes how many I had two I had two I didn't ask you anything yet you had two and Miss camer had two any other animals no so you lived started to live together during Co correct were you working yes was Miss CA working yes what was the rental on the apartment it was 1365 and you each played half correct so far correct was everything okay in 2020 September October November December as far as rent no as far as the living Arrangement oh um in 2020 yeah we just had many squabbles but overall we were just fine I'm going to ask you the same question in 2020 everything okay no what happened in 2020 it was emotional Warfare since I moved in with him it was there was arguments with everything even simple things like cleaning the dishes just non-stop I was terrified of him living with him I couldn't bring anything up without it being an argument okay so prior to moving in with Mr Hastings where did you live with my parents how old are you I'm 21 is this the first time you had an apartment yes and how far away were your parents from this apartment probably like 10 minutes if you were terrified you should have moved home I wasn't allowed to you weren't allowed to because because my um I just I wasn't allowed to live with my dad and stepmom because they moved into a 55 and over neighborhood when um they if you tell the truth you don't have to have a good memory they moved in a little after I moved into my apartment I moved into my apartment to prepare for them moving out I just don't want to hear drama if you had fights over who's going to clean the dishes and who I don't want to hear terrified unless you're terrified and if you're terrified and you're 21 years old you go back to where you came from to your parents house if you're terrified may not have of the household chores the defendant then made comments to the plaintiff that he would go crazy on her and raised his fist the defendant stated this multiple times and started shaking in Anger causing the plaintiff to be in fear for her life and you had a hearing on this yes you had a hearing on this you told this to a judge yes yes I want you to tell me what you told the judge or did you tell the judge anything I told the judge that I uh was raising my voice but I was standing a good amount of distance away from her at the time and that I was shaking because I wasn't being listened to and that was it there was no uh physical uh interaction there only verbal interaction did the judge say to you how would you describe shaking in Anger CU you weren't being listened to I was shaking just because I was angry I was just trying to keep my composure well that would frighten [Music] me Ryan Hastings claims his former roommate pyton Cammer for a security deposit and personal belongings Peyton is counter suing for rent and emotional distress now tell me did the judge say to you how would you describe shaking in anger because you weren't being listened to can you repeat that question shaking well that would frighten me actually I don't know whether I put you out of your house but that would frighten me Mr Hastings where are you living now I just moved into a new apartment with whom myself better yes and my cats perfect yourself and your cats great now I'm going to tell you Mr Hastings if that happened to me with a man who was larger than I was that might frighten me if he appeared out of control so I'm dismissing that part of your complaint which seeks damages for a false restraining order okay what you actually just testified to me and I took everything that she said in her complaint against you I didn't even have to ask her I wanted to know what you told the judge of course then it was a a reasonable issuing of a protective order just to make sure that it appeared to me what you were testifying to is that she couldn't tell the difference whether you were composing yourself or whether you were out of control okay so it was May I interject and just say that the restraining order was uh repealed and remanded saying that the court did not find sufficient evidence to impose the order and whether it was or not I just I don't care what I'm not sitting as an appell at court okay I'm sitting as a Trier of fact for the first time in your civil action and what you told me in my judgment was sufficient for a judge to say you know I don't want to preside over an assault case or a homicide case this guy says he was shaking she says he was shaking in Anger you say I was shaking to try to maintain my composure well I'm not going to worry about them let him go find someplace else to live which is what he did so I think that that's reasonable money owed for the return of security deposit now he was put out of the apartment he put in security deposit correct and he was put out of the apartment how much security deposit did he put in $682 are you still living in the apartment I am okay when he moved out of the apartment as a result of this restraining order was there any damage in the apartment that he caused no then you have to give him back his $682 because any damage that would have resulted since he moved out would be your damage okay that's fair enough $682 that's your security deposit sir return of belongings okay so when you were told that you had to vacate the apartment tell me what belongings you left in the apartment which you you think she still has which belong to you I do not believe she has anything anything of mine left in that apartment well what do you think she owes you for I am seeking the uh money for that for those items because they were thrown away what items um so I had a bed uh just a second you had a bed and there was a major flea problem in the apartment as a result of your cats correct okay she threw away the bed what else okay um there was a Nintendo switch do you know what that is Nintendo switch I never found that I believe he took that the night with him okay she didn't have it she didn't throw it away what else I also had a hookah that was in there oh what a hookah yeah do you have his hookah no go what's next um okay if you have to think about it that hard sir we're finished she owes you back your security deposit that's $682 you have a counter claim most of it is nonsense you counter claim for emotional distress get that only one emotionally distressed usually in this room is me money owed for the month's rent for a final month's rent what is that he didn't pay the month of September he was late on it the month of September but that would have been the $682 was he there in September um September 1st would have been the day that the money was due no when did he vacate the apartment as a result of your restraining order September 7th when the the night of the the
