[Music] n [Music] well hello there welcome back sooner than later right all right so as soon as I got off the other podcast pertaining to Richard Allen which if if you haven't already listened to the Richard Allen podcast from earlier this morning please go listen to that if you want to get yourself caught up I was talking about um well basically Richard Allen's confessions and how things will probably play out at trial and I was trying to go over some other piece of information that I found within that article um talking about a box cutter but it looks like that they they took out that information oh well anyways this podcast there has been a significant development within the Idaho 4 Brian koberger trial the judge has granted the motion for a change of venue this means that Brian cober's trial will not be held in Idaho Moscow Idaho it will not be held in Moscow Idaho um it will be moved to another location I'm assuming Boise Idaho I think last week the defense wanted to file a motion for a change of venue and they're arguing that their client Mr coburger if his trial were to be held in Moscow Idaho he would not have a fair chance due to the fact that the jury would be tainted and bias because a media coverage now there's some people that that's going to argue including the defense has argued it doesn't matter where you move the trial people have heard about this case but we'll be getting into that um again the breaking news is judge judge has granted granted the motion for a change of venue for Brian Christopher cerer we do have some breaking news that is just into our Newsroom a judge just granted a change of venue for Brian coburger he's the man accused of murdering for University of Idaho students and the court order does not State exactly where his trial will move to of course we will continue Gathering more information and we'll update you on this story on the Crim news at noon I'll try to maybe later on tonight um as far as the the shooter in Kentucky I haven't heard any major developments I think they're still searching for that guy but um yeah we'll be talking about that maybe later on tonight I'm following that case too but this is the latest development with the Idaho case there has been a change of venue granted for Brian cober's defense now this is interesting and this is somewhat we're we're watching his history being made because it's very rare for a judge to change the venue of a trial what does this mean for not only Brian's Brian cober's defense but also the prosecution because you know let's not forget about all of the cell phone kings that the prosecution is bringing into this case the route which they claimed in the PCA that Brian koberger took to get to Moscow Idaho from pman Washington uh the cameras that caught the white Elantra traveling from pman to Moscow the house which has since been demolished um all of this is going to play a factor into this so this now means and it's undetermined exactly where his trial is going to be held at they don't know if it's going to be held in Boise or Canyon County um but all of this information is going to have to be relocated will it actually make a difference that is the question I'm assuming that they're still going to hold it in Idaho um they do move some cases because of them not getting a fair trial because of social media coverage and the feelings of the local people yes correct and the defense recently had these surveys where they where they were surveying uh locals to Moscow Idaho and they were asking about about cober's trial and uh some locals within that area were saying that if he is found not guilty for whatever reason then they'll be willing to burn down the courthouse why is that important well that shows that's a reflection of how people feel towards this case so like what I've been saying you know personally I said this before if I were the judge I would move it out of Moscow for the sake of him getting a fair trial even if you want to argue that people have heard about this case all across the nation it's a high-profile case he definitely is not going to have a fair fair shot in Moscow due to the fact of how emotional um people are within that community they have their biases understandably so the town of Moscow Idaho ever since November 13th of 2022 has been under the microscope of the media with these crimes the University of Idaho has also expressed its concerns for wanting to move on and by doing that they've already taken the first step which was tearing down 112 to King Road the crime scene which was controversial on its own because some people they said that the jury should have walked through it now with this change of venue they can't the house is not coming back so I just want people to digest this information the house is torn down the crime scene is gone so whenever this does go to trial they're probably going to have a Model A replic model or Digital model of the house but the actual crime scene the actual vessel vessel is gone which means the jury is not going to be able to tour the house especially now since there's a change of venue they're not going to be anywhere near Moscow Idaho um yeah there's a lot of people that's not going to be happy with this de ision but I can see why the judge made the decision that he did because again he was not going to get a fair shot in Moscow period whether you want to want to believe that Brian koberger committed these crimes he is innocent until proven guilty in a court of law he deserves the right to a fair trial let's see what else we can find about this information um okay this is this is coming from news Nation hold on it's an advertisement we have an update on a high-profile national case that's gotten a lot of attention a judge has just approved Brian cob Berger's request to change the venue for his trial he is the suspect and the primary suspect accused of murdering four college students in their home off of campus in Moscow ID for University of Idaho students the court has not yet specified where the case will take place and where the change of venue will be but his defense had argued that he could not get a fair trial in Moscow Idaho where the murders took place in leau county and they had asked for it to be moved as far away as Boise but again we will wait and find out exactly where that trial will take place once it be and see let me go ahead and say this too I'm not saying that the families don't have a right to be outraged I'm sure that lot of families after hearing this hearing the judge's decisions are going to be not happy um if anything this this is going to cause further delays possible delays within the trial um it's also been said that the family members most of the family members of the deant are closer to Moscow Idaho opposed to wherever they're wanting to host this trial at my guess is that they probably compromise that as well they'll try to find a location where the families of the deant can easily get to that location it won't be too far out of the way but the families have the right to be they absolutely have the right to be outraged they've been waiting for justice for going on two years and his trial is not supposed to start until June of 2025 to begin with so you you can't you can't blame the families for being outraged but also you have to take into consideration Brian koberger uh getting a fair trial because again in the long term looking at longterm it was probably for the best that the judge made this decision because again if it was going to be held in Moscow Idaho and if he was found guilty then they can come back and say well he didn't receive a fair trial there were there was a tained jury because you all held it in Moscow and so that if that were to happen then that that would mean that the trial would be starting all over again so in order to have to avoid void the possibility of having a hung jury and that happening they moved it out of Moscow the real question is is it going to make a difference my guess is probably not it's going to not it's not going to make that much of a difference um but considering that if they choose to host it in Boise Idaho or some other city in Idaho that has a higher dense population it would he would have more of a fair shot at at receiving unbiased jurors I don't know if I phrased that correctly I didn't want to be confusing it is a justice system it's what's messed up really putting crap off and everything yeah you know there's a lot of issues with it let's go over to I'm not going to be playing Court TV's entire commentary but I do want to I want you guys to Listen to A short segment of what they said so again Brian koberger the judge in charge of his case has granted the motion for a change of venue this means that his trial will not be held in Moscow it will be held somewhere else you're absolutely correct it is incredibly incredibly rare for a judge to to Grant a change of venue um it's a very complicated motion uh very uh time consuming and you have to hire you know experts that bring in statistics analyze media um obviously this is going to be an unpopular decision for a judge uh to take a the sense of justice away from a community to try their own case uh however I think that the judge made the right call uh the these crimes were so heinous and so well covered on the media that uh see and I've already lost one person by talking about this I don't care guys you know I you don't shoot the messenger I'm just here delivering the news if you want to be mad at anybody I'm not talking to anybody in the chat in particular um I'm talking about the people that get mad at me repeating this information and bringing you the news and some people they get really emotional and really pissed off and so the messenger me gets the back end of that or the media for delivering this news I'm just repeating what has been done what's been said again this is breaking news you can like it you canot like it but it is what it is even if there was a a well if there was a conviction in the case in that town there really would have been a big chance for uh an appeal to win based on uh that the trial was not fair and so I think the Judge uh made the right call by being able to move the what I just said exactly and preserving the that is exactly what I just said the state was hopeful that it wouldn't be moved let's go ahead and play a little bit of the state's argument finally since we are talking about the interests of Justice in the convenience prong of the rule it is completely appropriate for the court to also consider the fact that most of the victim's families not all of them but most of them live closer to Le County than they do to boisey and that is something Joseph that the judge had to take into account and again in his ruling we're just kind of getting through it right now but it did say I have to take everything into consideration here obviously that was one of the factors so my question is is the family members uh on behalf of the state of Idaho is is the state of Idaho going to pay for the expenses on behalf of the family for them to travel to Boise or wherever this trial is going to be held my guess is they will they'll find a way to set up reserv ations for the family they have to I mean this this is going to be a three-month trial it's not he's not going to trial until next year June 2025 but it's not supposed to end until August of 2025 we're talking about housing the vi the victim's families they have to be compensated uh the prosecution has to be compensated for their expenses putting up a place for them the defense um the witnesses and also the jury oh of course yes and that's why uh this was a difficult decision for the judge because there's a community here um and and victims and Witnesses and law enforcement Court Personnel that now have to uh try this case you know away from from the community at at at greater expense I wonder if they're going to keep the same judge I wonder that I wonder if they're going to keep the same judge or if they're going to get a different judge and greater inconvenience to the party however um the judge has to weigh in terms of all Total Justice can this apprciate a fair trial and uh in in extreme situations like this where you have an extreme case uh and you know the accusations are extreme they may that's when you will see these motions are granted but they're very incredibly rare it's a very high burn to make but I think the Judge like I said before made the right call um because otherwise if there's a conviction in a case and it wasn't a fair process then the defense can turn around and appeal and say look at this me coverage it was biased um this person yes they were convicted but they did not get a fair trial so I think in the long run the judge made the absolute right call and um and sort of uh foreclosed that that app pellet uh issue by moving the the trial now do you think it will make a difference when it comes to these jurors and how many of them will be impacted by outside coverage having known about this that's a very good question news and I do want to go back to what the defense said during this change of venue motions hearing that we covered that happened of course before this order came out let's take a listen back to that and get your thoughts on it Joseph it's hard to imagine that one of those jurors who all of a sudden said you know what I'm not sure and listen to more evidence and said I'm really not sure I don't think he did it are they going to be brave enough to do that to write not guilty to say not guilty hold on for one second I'll be right back e okay so what the defense is saying is even if the trial were to be held in Moscow and if they had that one juror in the pool despite the evidence that the state brought against coburger if they if they truly believe that he's innocent and they truly believe that all of this is circumstantial would they even want to vote not guilty just primarily based off the pressure of that Community even if they think he's not guilty will they deliver that verdict out of the pressure that's being put on them by the community keep in mind that during these surveys and research they went to Facebook they went to social media and they were they were looking at what people were saying about the coburger trial they were scrolling down to the comments on numerous posts and some people within Moscow Idaho was saying that they would be willing to burn down the courthouse if he was found not guilty there would be a mob likee mentality within that community and they have the right to feel the way they do because this happened within their Community what they're saying is even if a juror wanted to deliver a not- guilty verdict they probably wouldn't because of the pressure that's been put on them by that Community I understand what I understand what you're saying that comes right to impartiality imagine with me that we are here in June of 2025 and we're here and we've seated 16 or so people over here you're going to recognize some of them people that sit in the courtroom in our audience that want to come and listen to the trial are going to see them even if they don't listen to the trial people are going to know whose car leavs their driveway every morning to get to the courthouse by 8:30 for three solid months and those jurors that sit over there are going to feel an immense amount of pressure to answer the call of the community to be safe I've dropped my lip liner for lip saying and it's changed my life 10 hours of transfer col well see I believe they said that even if he was you know a Le even if he wasn't convicted even if he was convicted of a lesser charge uh let's say that he gets life in prison without the possibility of parole they said they would still not be satisfied with that verdict they want him they're in favor of the death penalty that Community out there in Moscow wants to see coburger uh brought to Justice via death penalty because in the court of public opinion out there in Moscow they believe he is the guy who did this they've already had their minds made up most of that community and they want him put to death they are not going to be satisfied with life in prison without the possibility of parole and I believe that um if I'm not mistaken Mr G Gales Kaye gz's father has said the same thing that he wants to see whoever um put to death they don't want Brian koberger if he's the one convicted sitting behind bars like the uh BTK killer writing books in writing prophetik did they don't want that as being an outcome I don't know you're dealing with a community who is very emotional understandably so I'm not saying that they're wrong for feeling the way they do but for the sake of him getting a fair trial you don't want people who already have their minds made up about this case you want open-minded Fair [Music] jurors so again Brian koberger has been granted a change of venue by the judge what is going to be coming next of this of this case you know Dennis Raider for 20 to 30 years yeah that's the thing about Ida uh excuse me that's the thing about Idaho the last time that they convicted some or put somebody to death was back in 2012 now they tried to put somebody to death back in [Music] 2022 however something happened where they they weren't able to find um the guy's vein his IV line you know they couldn't find his IV line so they halted the execution but they were they were going to execute somebody in 20202 but they couldn't because of that mere Factor so even if he were to be sentenced to death and he still may be sentenced to death I mean this is not a guarantee that he's going to get a fair trial so so even if he were to be sentenced to death he can still sit on death row for years and years and years Idaho has only executed how many times has Idaho executed a person it's only carried out 29 executions since 1864 Idaho has carried out 29 executions since the death penalty was established in 186 64 the last person to had been executed in Idaho was back in 2012 this is coming from NB C news I'm just playing short segments of these news outlets of this latest development of the coburger case quadruple murder case the court granted the suspect Brian cober's request to move that trial out of leak County that is where the 2022 killings took place in an off-campus House near the University of Idaho campus now in this ruling the judge sided with the defense which argued that jurors from Le County would most likely have been biased because because of this intense media coverage that's been surrounding the trial NBC News legal analyst Danny sabales joins us now Danny I think a lot of people were surprised by this decision I mean at the end of the hearing about this change of venue request last month the judge said that this would be the most difficult decision of his career what did you make of the ruling most of these change of venue motions are denied however it's really a two-part burden on the defense I mean they essentially have to show that they can't get a fair trial in this count in Le County but also that another County would be better and the defense really marshaled the expert testimony and evidence in this case they got some top experts including an expert who conducted surveys who really met that burden and it is not an easy burden to meet especially in the modern era where jurors in virtually any County in any state or even any country can look on their cell phone and learn all about the Brian cerg I mean very true there's people that are abroad of the US in the UK Australia New Zealand Germany Scotland Canada it doesn't matter where you are if you follow True Crime if you follow these high-profile cases chances are you know about the Idaho 4 or the four University of Idaho students or the coburger case the cerg trial uh whatever you want to call it you've heard about it in the day of modern modern technology anybody can pull up their phone type in Brian coburger in Google or YouTube and all of this information will pop up so again is it going to make that much of a difference that it's being held in Boise or somewhere else in Idaho who knows so this is a surprise in the sense that these motions are not normally granted but if there was a case to be made the defense really put up a Herculean effort by getting together multiple experts to show through surveys and through psychological expert testimony that another County would be better than this County yeah this case has been so widely coverage n covered nationally even internationally Danny well yeah y'all see there's there's a breaking news so that's pretty much it for this podcast I just wanted to get on here and let you guys know that there's been an update pertaining to Brian cober's trial again the change of venue has been granted by the judge in in charge of the Idaho case um they don't know where his trial is going to be held at exactly yet I'm sure we're going to be hearing more about that information in the coming future but it's not going to be held in Moscow Idaho it's going to be held in Boise or somewhere else so you tell me what you think
