Brooke Jenkins making it clear tonight that she does not have the authority to automatically file charges against the 17 year old in adult court. She has to first ask the judge to do so, and she is considering it. Meanwhile, the deputy public defender representing the teen saying the 17 year old and his family are sorry this happened. The attempted robbery and shooting of 49ers wide receiver Ricky Pearsall has captured the attention of people nationwide, putting crime and safety in San Francisco under a spotlight. Tonight, District Attorney Brooke Jenkins saying she's disappointed the incident is being used in a political manner. I feel a pressure to make sure that San Francisco is safe. None of the decisions that are made in my office can be political or based on political interests. We simply have to base our decisions on the facts of what happens and the law that's in front of us today. The 17 year old, accused of robbing and shooting Pearsall near Union Square, went before a judge. He sat quietly as the judge read aloud the seven charges. We're blurring the sketch of the teenager's face because NBC Bay Area does not identify minors accused in juvenile cases. Among the charges he's facing attempted murder, assault with a semiautomatic gun, and second degree attempted robbery. The teen's parents were in court. His mother wore headphones for a Spanish interpreter. Deputy public defender Bob Dunlop is representing the teen. He's very sorry, genuinely, that this did happen, as is his family and I can say on their behalf as well as on my own behalf that, our thoughts go out to the Pearsall family and Mr. Pearsall himself. The judge ordered the teen be held in custody until trial. D.A. Jenkins saying tonight she is considering requesting that the court allow them to transfer this case to adult court. Right now, that is under consideration. And given the timeline of this case, because the minor was kept in custody, we have a very short, tight timeline for me to make that decision.
